1.WAYNESVILLE OFFICE SPACE AVAILABLE: Haywood County attorney, Bob Clark, is seeking an attorney with a civil practice (with receptionist) to share newly re-modeled space on the 2d floor at 160 N. Main St , Waynesville (The Professional Building).  Rent, with utilities included, would be about $375 and he is willing to share internet and research expenses.  Window over Main St. with mountain view .  Please call 452-4551.  Bob’s practice is 100% criminal.  The office space will be available on November 1. 2. ETHICS ADVISORY UPHELD: You may remember an earlier discussion on this web site regarding the State Bar's discipline of 2 lawyers who had engaged in ex parte communications with judges. These rulings by the bar prompted Monty Beck to write the State Bar regarding concerns he had about the Bar's ruling (click here for Beck letter to Bar). In May, 2008, the State Bar responded to Monty with an ethical advisory (click here to read EA-2411). The last paragraph of the ethical advisory stated "You may rely on the advice contained in this letter pending its review by the ethics committee at its July quarterly meeting. Should the committee then decide that my advice should be altered in any material way, you will be notified promptly." Monty has recently contacted me with an update on this advisory opinion. Apparently the entire Bar ethics committee met and approved the EA without modifications. (9/30/08)

3.6-MONTH CALENDAR CHANGES: There will be a couple of switched judicial assignments on Wednesday, November 5, 2008. Judge Holt, who was scheduled for the Cherokee County criminal term will, instead, handle the Haywood County Other term originally assigned to Judge Walker. Judge Walker will be handling the duties in Cherokee criminal court that day. Judge Letts will be finishing an equitable distribution case in Haywood County on November 5. Judge Leslie will be presiding over the Macon Other term originally assigned to Judge Letts. To view the Walker-Holt order, click here. To view the Leslie-Letts order, click here. (9/24/08)

4.OCTOBER 7, 2008 HAYWOOD DOMESTIC TERM: I previously announced that my 4 day Haywood County domestic relations term would be shortened to 3 days because I was being assigned to Macon County on Thursday, October 9, 2008. While the term will remain shortened to 3 days, my assignment has changed and I will be presiding at the October 8, 2008 session of Haywood other court. (9/19/08)

* Please note the correction to the above message. I previously erroneously posted that I would be in Macon County on October 8. I will be handling the Haywood County criminal term on 10/8/08 and not the Macon County term.
